Terms of Service

These Terms of Service ("Terms") govern the use of the website and services provided by NDEVATION Co., Ltd. ("NDEVATION", "we", "us"). By accessing our website or using our services, you agree to comply with these Terms.

NDEVATION provides the following services: • Custom software outsourcing. • Website design and development. • Mobile application development. • Technology consulting. The specific scope of each project will be agreed upon separately in a contract or project proposal between both parties.

All content on this website — including text, images, logos, designs, and source code — is owned by NDEVATION or its respective licensors. You may not copy, distribute, or use it for commercial purposes without written consent. For software products developed under contract, intellectual property rights will be specified in each project agreement.

When using our services, you agree to: • Provide accurate and complete information as required by the project. • Cooperate promptly during the development process, including providing feedback, reviews, and acceptance. • Not use services for purposes that violate Vietnamese law. • Make payments on time as agreed in the contract.

Specific payment terms will be outlined in the project contract. Generally: • Payments are made in milestones as agreed. • Invoices are sent via email and paid by bank transfer. • Refund policies apply as specified in each individual contract. Additional costs outside the original scope will be communicated and approved before work begins.

After product delivery, we provide a warranty period for bug fixes as agreed in the contract (typically 3 to 6 months). The warranty covers software bugs within the accepted scope. Feature changes or additions outside the original scope will be quoted separately.

We are committed to keeping all project information, business data, and technical documentation provided by clients confidential during and after collaboration. NDEVATION employees and contractors sign appropriate non-disclosure agreements (NDAs).

To the maximum extent permitted by law, NDEVATION shall not be liable for: • Indirect, incidental, or consequential damages arising from the use of services. • Service interruptions caused by force majeure (natural disasters, network failures, government policy changes). • Losses resulting from inaccurate or incomplete information provided by the client. NDEVATION's total liability shall not exceed the value of the corresponding contract.

Either party may terminate the collaboration according to the terms specified in the contract. In the event of early termination, both parties will settle payment for completed work and hand over documentation and source code as agreed.

These Terms are governed by the laws of Vietnam. Any disputes will be resolved through good-faith negotiation. If no agreement can be reached, disputes will be submitted to the competent court in An Giang Province.
